(1) These Terms and Conditions (hereinafter "T&C") apply to the purchase of admission tickets, e-tickets, registration codes and participation entitlements, to the use of digital platforms and examination services (in particular the Stock Exchange Licence), to the issuance of certificates, and to all other paid services of the Bundesverband der Börsenvereine an deutschen Hochschulen (BVH) e.V. (hereinafter "BVH e.V.") offered via the website, the ticket shop or any other booking channel provided by BVH e.V.
(2) The provider and contracting party is, unless another organiser is expressly named in a specific case, BVH e.V., Schloss, 68131 Mannheim, registered in the association register of the Amtsgericht Mannheim under VR 1772. Point of contact for questions about the ticket shop: [email protected]
(3) "Events" within the meaning of these T&C include in particular conferences, symposia, strategy and networking events, training courses, workshops, competitions, digital formats and other offerings of BVH e.V. "Tickets" are admission tickets, e-tickets, QR codes, registration codes or other participation entitlements. "Stock Exchange Licence" refers to a digital learning and examination offering provided by BVH e.V. via a technical platform, where a certificate is issued after passing the examination upon a separate paid order.
(4) These T&C apply regardless of whether the customer is a consumer, entrepreneur, association, university, member club or any other organisation. A consumer is any natural person within the meaning of § 13 of the German Civil Code (BGB). An entrepreneur is any natural or legal person or partnership with legal capacity within the meaning of § 14 BGB.
(5) The version of these T&C in force at the time of concluding the contract shall apply. Deviating conditions of the customer shall not apply unless BVH e.V. expressly agrees to their validity in text form. Supplementary participation conditions for individual events take precedence over these T&C to the extent that they are more specific and are made available to the customer before the contract is concluded.
(1) Participation in BVH e.V. offerings may be restricted to direct or indirect members, member clubs, their members, students, partners, invited persons or other groups specified in the respective offering.
(2) BVH e.V. is entitled to verify eligibility for participation and to request appropriate evidence, such as proof of membership, university affiliation, company affiliation, invitation or age.
(3) If a ticket is erroneously purchased by a person who is not eligible to participate, or if the conditions for participation are not met, BVH e.V. may cancel the contract and refund the ticket price paid. No further claims shall exist to the extent permitted by law.
(4) BVH e.V. may exclude persons from participation if they violate these T&C, house rules, participation conditions, safety requirements or the legitimate interests of BVH e.V., other participants or event partners.
(1) The display of events and tickets in the ticket shop does not yet constitute a legally binding offer, but rather an invitation to the customer to place an order.
(2) The customer submits a binding offer to conclude a contract by selecting the desired event or service, entering the required data, accepting these T&C and submitting the order via the "order subject to payment", "book subject to charge" or correspondingly labelled button.
(3) Before submitting the order, the customer receives an overview of the key order data, in particular event, ticket type, quantity, price, VAT indication, billing data and payment method. Input errors can be corrected before submitting the order.
(4) The contract is concluded as soon as the customer receives an order or purchase confirmation by email. The confirmation may also contain the invoice or announce the separate dispatch of the invoice.
(5) BVH e.V. may refuse to accept an order, in particular if participation requirements are not met, the event is fully booked, payment or credit risks exist, or technical errors occur in the ordering process.
(1) The contract language is German. Where content is also provided in English, the German version shall prevail in matters of interpretation unless otherwise expressly agreed.
(2) BVH e.V. will transmit the essential contract information, in particular the confirmation, ticket information and these T&C, to the customer by email or make them available for retrieval in the ticket shop.
(1) The subject matter of the contract is the service booked or used in each case, in particular participation in a specific event, the purchase of a ticket, participation in a competition, training course, digital examination offering such as the Stock Exchange Licence, or any other offering.
(2) The specific scope of services is set out in the respective service description in the ticket shop, the event page, the platform description, the order overview, the confirmation and any supplementary participation or examination conditions.
(3) Claims to services beyond those described, specific speakers, specific programme items, specific seats, specific participants or a specific group composition only exist if expressly guaranteed.
(4) BVH e.V. is entitled to make reasonable organisational changes as long as the overall character of the event is preserved.
(5) For the Stock Exchange Licence, BVH e.V. provides the participant with a digital platform for the learning and examination offering. Claims to a specific technical configuration, permanent availability outside specified usage periods or specific individual content only exist to the extent expressly guaranteed.
(6) Taking the test under the Stock Exchange Licence is free of charge unless otherwise expressly stated. Free test completion does not create any entitlement to issuance of a certificate without a separate paid order.
(7) A certificate for the Stock Exchange Licence is only issued if the participant has passed the examination and the issuance has been separately ordered at a charge. The paid certificate contract relates exclusively to verifying entitlement and creating and providing the certificate.
(8) The certificate is created using the personal data provided by the participant, who is obliged to provide this information fully and accurately. BVH e.V. is only liable for errors resulting from incorrect or incomplete information in accordance with the statutory provisions and these T&C.
(9) Passing the examination, a specific learning outcome or a specific professional, academic or other benefit of the certificate is not guaranteed.
(1) Tickets are generally provided electronically by email, as PDF, QR code, mobile ticket, wallet file, registration code or via another form specified in the booking process.
(2) Registration codes as such do not necessarily entitle the holder to admission. Where personalisation or registration is required, the entitlement to admission only arises after successful registration of the respective participant.
(3) The customer must immediately check the tickets and confirmations received for correctness and completeness. Complaints must be communicated to BVH e.V. in text form as promptly as possible. The statutory rights of consumers remain unaffected.
(4) BVH e.V. may make admission conditional on presentation of a valid ticket, identity document, proof of membership or participation entitlement, and receipt of payment.
(5) In the event of loss, unauthorised transfer, multiple use or misuse of a ticket, admission may be refused. BVH e.V. is entitled to block tickets in cases of payment reversal, cancellation, misuse or lack of participation entitlement.
(1) The prices stated in the ticket shop or service description at the time of ordering shall apply, inclusive of applicable statutory VAT unless otherwise expressly stated.
(2) The tax classification of individual events or services is governed by the applicable tax regulations. BVH e.V. may apply different VAT rates depending on the type of event or service.
(3) Use of the platform and taking the test under the Stock Exchange Licence are free of charge unless otherwise agreed. A charge applies only to the separately ordered certificate issuance after passing the examination.
(4) The total amount is due for payment upon conclusion of the contract unless a different payment period is stated.
(5) Payment is made via the payment methods indicated in the booking process (in particular bank transfer on invoice, credit card or SEPA direct debit). There is no entitlement to a specific payment method.
(6) If a payment fails or the invoice amount is not received in time, BVH e.V. may block the ticket, refuse access or withdraw from the contract to the extent permitted by law.
(7) Any bank charges or direct debit reversal fees attributable to the customer may be charged at their actual amount, to the extent permitted by law.
(1) If the payment method "invoice" is selected, the invoice will be transmitted electronically after the contract is concluded.
(2) The invoice amount is due without deduction within 14 days of the invoice date, unless a different payment period is specified.
(3) BVH e.V. reserves the right to refuse access or block tickets until full payment is received.
(4) The customer must provide complete and accurate billing details, in particular when ordering as a company, association or university.
(5) To the extent required by law or agreed, the invoice may be provided as an electronic invoice in a structured electronic format.
(1) For contracts relating to tickets for events, training courses, seminars, competitions or other offerings scheduled for a specific date or period, consumers generally have no right of withdrawal pursuant to § 312g(2)(9) BGB. This also applies to date-related digital formats and examination offerings where the statutory requirements are met.
(2) The order of such tickets is binding upon conclusion of the contract and obliges the customer to pay the agreed price.
(3) Where individual services exceptionally fall under a statutory right of withdrawal, the customer will be informed separately. Statutory rights remain unaffected.
(4) For a paid certificate issuance under the Stock Exchange Licence, BVH e.V. may make commencement of performance before expiry of the withdrawal period conditional on the consumer expressly requesting this.
(1) The return, cancellation or refund of purchased tickets is excluded unless there is a statutory right of withdrawal or a case of cancellation or postponement pursuant to clause 11 applies.
(2) Unused tickets are not refunded, in particular in cases of no-show, late arrival or non-participation attributable to the customer.
(3) Costs for a paid certificate issuance are not refunded if the certificate was issued at the consumer's express request before expiry of the withdrawal period and the right of withdrawal has lapsed.
(4) Transfer of tickets to other persons is only permitted if the event allows for this or BVH e.V. consents in advance in text form. Personalised tickets may not be transferred without consent.
(5) Tickets may only be passed on to persons who meet the respective participation requirements.
(6) Commercial resale of tickets is not permitted. Non-commercial resale is only permitted at the original ticket price plus verifiable costs, where transfer is permissible under these T&C.
(1) BVH e.V. is entitled to cancel, postpone or make reasonable adjustments to events for good cause.
(2) Good cause exists in particular where key speakers are unavailable, illness, official requirements, force majeure, strikes, security risks, insufficient number of participants, failure of the venue or technical disruptions at digital events.
(3) In the event of complete cancellation by BVH e.V., any ticket price already paid will be refunded.
(4) In the event of postponement, tickets generally retain their validity for the replacement date. If the customer cannot reasonably be expected to attend the replacement date, they may request a refund within a reasonable period notified by BVH e.V.
(5) Programme changes do not entitle the customer to a refund, provided that the overall character of the event is preserved.
(6) Further claims for reimbursement of travel, accommodation, catering or other consequential costs are excluded unless the damage is based on intentional or grossly negligent conduct by BVH e.V. Liability pursuant to clause 15 remains unaffected.
(1) At in-person events, the respective house rules of the venue, safety requirements of BVH e.V. and the instructions of event staff apply.
(2) BVH e.V. may exclude participants from an event if they disrupt it, violate safety requirements, participation conditions or house rules, or impair the legitimate interests of BVH e.V., other participants, partners or the venue.
(3) In the event of justified exclusion, no refund of the ticket price shall be due if the exclusion is attributable to the participant.
(1) All content, documents, presentations, videos, recordings, examination content, platform content, certificate templates, logos and other materials provided by BVH e.V., speakers or partners are subject to copyright or other intellectual property rights.
(2) Use is only permitted for the customer's own, non-commercial purposes in the context of the event, training course, examination or certificate, unless otherwise expressly agreed.
(3) Reproduction, publication, distribution, commercial use or any other exploitation of platform, learning or examination content is not permitted without the prior consent of BVH e.V. or the respective rights holder.
(4) Audio, photographic or video recordings by participants are only permitted if BVH e.V. expressly authorises them or statutory permissions apply.
(1) BVH e.V. processes personal data exclusively in accordance with the applicable data protection regulations, in particular the GDPR and the German Federal Data Protection Act (BDSG).
(2) Personal data is processed in particular for contract management, payment processing, participant management, access control, conducting examinations, issuing certificates and fulfilling statutory obligations.
(3) Personal data is only transferred to service providers to the extent necessary for contract performance.
(4) Personal data is only disclosed to sponsors or other third parties for their own purposes where a legal basis exists or the participant has previously given separate consent.
(5) Further details are set out in BVH e.V.'s privacy policy and event-specific data protection notices available on the website.
(1) BVH e.V. is only liable for damages arising from a breach of a material contractual obligation or from intentional or grossly negligent conduct by BVH e.V., its legal representatives or agents. Where a material contractual obligation is breached through slight negligence, liability is limited to the foreseeable damage typical for this type of contract.
(2) Any further liability for damages is excluded. Liability for culpable injury to life, body or health under statutory provisions remains unaffected. This also applies to mandatory liability under the German Product Liability Act.
(3) BVH e.V. is not liable for cloakroom items, personal belongings or other consequential costs unless a case within clause 15(1) or (2) applies.
(4) To the extent that the liability of BVH e.V. is excluded or limited, this also applies to the personal liability of its legal representatives, officers, members, employees and agents.
(1) Supplementary conditions may apply to individual events, competitions, training courses or digital formats.
(2) Such special conditions will be made available to the customer before or at the time of concluding the contract. They apply in addition to these T&C and take precedence over them to the extent that they are more specific.
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
(2) Where consumers are concerned, this choice of law only applies to the extent that it does not deprive the consumer of the protection of mandatory consumer protection provisions of the country of their habitual residence.
(1) Should individual provisions of these T&C be or become invalid, the validity of the remaining provisions shall remain unaffected.
(2) Individual agreements take precedence. Amendments or additions to the contract require text form unless the law prescribes a stricter form.
